Agreement for
Institutional
On-Site Workstation Access to NEJM Online

Institutions that have purchased a "Print Plus 5 Workstations" subscription to The New England Journal of Medicine (NEJM) can activate up to five (5) on-site workstations to access the NEJM Web site, NEJM Online. Your institution’s use of and access to NEJM Online is subject to the provisions of this Agreement.

Definitions:
        Authorized Users are faculty members, registered students, staff members (“employees”) of your institution, or visitors using Registered Workstations.

        Registered Workstations are computer workstations physically located on the premises of, and controlled by, your institution.

Authorized Access to NEJM Online:
Access to NEJM Online is controlled by valid IP address(es) and is granted only to Authorized Users at Registered Workstations with discrete IP address(es) for the duration of your institution’s subscription term. Proxy servers and dynamic IP address(es) are not permitted. Information submitted to activate on-site workstation access to NEJM Online must be complete and accurate.

Interlibrary Loan:
Licensee may, on occasion, supply single copies of materials from NEJM Online to a noncommercial library located in the same country as Licensee in accordance with Licensee’s interlibrary loan procedures, whether by post, facsimile, or digital transmission, provided that (1) a written notice stating that any electronic copy must be deleted immediately after printing and that the end user can only receive a single paper copy is sent to the borrowing library and (2) Licensee has a good faith belief that such notice is being complied with.

NEJM Web site Terms and Conditions:
By using NEJM Online, institutional subscribers agree to be bound by the NEJM Online Terms and Conditions, which are expressly incorporated by reference herein. Institutional subscribers agree to cooperate in preventing violations of the NEJM Online Terms and Conditions by Authorized Users and, in addition to any other applicable remedies, access to NEJM Online may be may be limited or revoked in the event of a violation of the NEJM Online Terms and Conditions by an Authorized User.

Exception for Public Institutions:
The choice of law and forum designation set forth in the NEJM Online Terms and Conditions shall not apply if compliance would violate (1) any law, regulation, or official governmental policy or (2) any bylaw or equivalent governing instrument of Licensee.
